37th Amendment of the Indian Constitution

The 37th amendment of the Indian constitution came into inception on 19 March 1975. It dealt with the reorganization of the legislative and administrative wing of Arunachal Pradesh. Part VIII of our constitution deals with The Union Territories. By this amendment to Article 239A and Article 240, local legislatures and council of ministers were provided for Arunachal Pradesh.

Background

Before attaining statehood, Arunachal Pradesh was a Union Territory administered by a Chief Commissioner. It had a Pradesh council as an advisory body consisting mostly of Zila Parishads representatives.

In the Twenty-sixth year of the Indian Republic, certain changes concerning Arunachal Pradesh were proposed in the Parliament. The central government proposed the local legislature and council of ministers thereby making it one of the territories with legislatures ( others being Mizoram and Pondicherry ).

Important Provisions related to the 37th Amendment of the Indian Constitution

Part VIII of the Indian constitution deals with the Union Territories. 37th constitutional amendment act substituted “Arunachal Pradesh” in Articles 239A and 240.

Article 239A deals with the power of Parliament to create local legislatures or councils of ministers or both for certain Union Territories. Originally, the UTs present in this Article were Mizoram and Pondicherry. By this amendment, the UT of Arunachal Pradesh was given the same status as the other two.

Article 240 deals with the power of the President to make regulations for certain UTs. Here, a new entry (g) was added which empowered the President of India to make regulations for the Union Territory of Arunachal Pradesh.

The important thing to remember is that these legislative powers of The President can be exercised only when the Legislative assembly is either suspended or dissolved.

Present Status

Under the State of Arunachal Pradesh Act, 1986 the above said amendments of articles were deleted and the country’s north-easternmost Union Territory was given full statehood on 20 February 1987.

Summary

The act brought in major amendments to the functioning of the UT of Arunachal Pradesh. Presently, these amendments do not apply to the state and the substitutions in Article 239A and Article 240 were omitted.
